Capital punishment, also known as the death penalty, has laws that date back to the Code of Hammurabi in Babylon. The first recorded death penalty case took place in the 16th century BC where a man was sentenced to death for his alleged use of magic. The death penalty in the United States was influenced by Britain power over the original thirteen colonies. In the 1700’s, Britain had two hundred and twenty-two crimes that could be punished by death. The first legal execution in the United States took place in Virginia in 1622 where the defendant was put to death for theft (PBS). The first state to abolish the death penalty for all crimes except treason was Michigan in 1846. The Eighth Amendment states, â€Å"excessive bail shall not be required, nor excessive fines im posed, nor cruel and unusual punishments inflicted (Cornell).† The argument against the use of the death penalty is rooted in the Eighth Amendment because of the â€Å"no cruel or unusual punishment† clause. The proportionality requirement only allows a punishment to be proportional to the crime, thus making the punishment neither cruel nor unusual. In determining proportionality, the court must have â€Å"a consideration of the offense s gravity and the stringency of the penalty; a consideration of how the jurisdiction punishes its other criminals; and a consideration of how other jurisdictions punish the same crime. According to landmark court cases Coker v. Georgia (1997) and Kennedy v. Louisiana (2008), the death penalty cannot be used in the rape of a n adult woman or of a child if the victim did not die. The whipping boy concerns a family slavery farm, where they have three slaves Mikey, Tommy and Martha. One day on the farm a boy from the Union comes to the farm and breaks the news, that they are freemen and they can do whatever they want. The news thrills Mikey and Tommy, but Martha is still a bit insecure about the situation, because she is taking care of the old Mrs. Gage, who lives on the farm with her son Master Sterling Gage. Master Sterling Gage is not at the farm when the news arrives, and Martha is therefore concerned for old Mrs. Gage, that she will starve to death. The three slaves stays on the farm, and one day, when Mikey is laying on the couch inside his former masters house, with a bottle of bourbon, Master Sterling Gage returns home and catches Mikey in the act. He gets furious and hits him. Master Sterling Gage goes out of the house, to saddle his horse because he has to go into town, but Tommy and Mikey attacks him from behind and nearly kills him. Martha breaks it off, and they escape instead, they do not make it far until some confederate soldiers stop them, and they kill the three freed slaves. The story is set in the middle of the 1800th, which also in real time had meaning in history. The civil American war started in 1861. It all started when several states abolished slavery. The new president Abraham Lincoln wanted all states to be free from slavery, but some states disagreed, they resigned from the Union and became the confederate states with Jefferson Davis in front as their president. Now th ere was two opposite poles against each other, and the civil war began. The war resulted in releasing all the slaves in the confederate states also. A confederate fanatic murdered Abraham Lincoln a week after the war was over, but he died a hero to many.1 This you easily can relate to the short story â€Å"The Whipping Boy†. A boy from the union (Abraham Lincoln’s side) informs the slaves that they are freemen and they starts a riot on the farm† It was the day after the boy from the Union had come to the farm to let the slaves know they were freemen†2. Afterwards they escape the farm but bumps  into some confederate soldiers (Jefferson Davis’ side) that later on kills the free slaves. â€Å"Tommy was shot when he drew Sterling Gage’s pistol while they were being questioned. â€Å"3 You get this information, probably to relate to the real time history, when confederate soldiers still thought that race should be a main key in the society, and there should be no changes made. We follow in our short three slaves: T ommy, Mikey and Martha. Tommy and Mikey are working in the field, while Martha is inside their master’s house, serving the old Mrs. Gage. Martha and Mikey have had an affair, but their master Sterling Gage have been beating Mikey, when he found out. Martha is the quiet one, with most sympathy among the three slaves. She is the one begging Mikey and Tommy not to kill Master Sterling Gage, when they are beating him up â€Å"†Mikey,† Martha Begged, still pulling at Tommy’s arm, â€Å"Tell him to stop†Ã¢â‚¬ 4. Tommy and Mikey on the other hand is very straightforward, they want revenge for the things that they have been experiencing through the years on the farm â€Å"He had grown alongside Sterling as a young boy and had considered him a friend until the day Sterling had pilfered some sugar from the larder.†5 Master Gage Sterling is the person running the farm. He owns it, but is away allot and must therefore have Martha taking care of his old and demented mother Mrs. Gage. He has this static controlling aura, and makes the reader fear him. The short story makes the reader feel sorry for the slaves; because it is from their point of view, it is written. We hear about how tragic Mikey’s childhood was at the farm, and how they have to work hard every day to serve their master. When they then escape from the farm, the reader feels that justice has been done, but then feels sympathy with the slaves, when the confederate soldiers slaughter them. â€Å"The Whipping Boy† is a short story, which we can relate to a certain time in history. We can draw lines to the real world and see a connection and in the short story, it is the same people it is about and the same characters, and titles on the persons. Slavery is a problem still but the time in the 1800th was a time of big changes, and have been a very important landmark through history.

Brother of Sleep

Brother of Sleep is presented in a very romantic and musical style. It focuses on Elias who was born a musical genius. He does not only have a musical talent but also has an unbelievable gift to see and feel things beyond the usual. This makes him very strange in the eyes of the townspeople. He grows up with his friend Peter and his sister Elsbeth. At the beginning the main character appears to be enjoying his gift of music. However, as he grows older and understands his environment more, he starts to become trapped in an inescapable life. He was caught between his emotions and his calling for music.His musical gift has prevented him to follow his heart which terribly longs for the love of Elsbeth. Although Elsbeth also loved Elias, things got twisted and she marries another man. In the movie, it was portrayed that Elias knew beforehand that Elsbeth was meant for another man. Despite this, Elias was still devastated with the loss of his love and he decided to kill himself. He decided not to sleep which he considers the best way to end his life. Only age 22 when he died, the main character was a victim of himself and his environment. I think that the plot of the story is unique and at the same time very rich in morals.It was a very vivid way of presenting audiences with dilemmas which normally arise in people with talents who wish to do other things that they love. It was a sort of eye-opener for many who have watched. Moreover, I think the creation of the film is very artistic because of the incorporation of music, which is very relevant to the plot, as well as the use of twists and humors in the story. The Island of Lauropia

Secluded in the middle of the Atlantic Ocean, is a place called Lauropia, a wonderful society. It is always peaceful and nothing bad ever happens on the island. The island's air is always fresh and free of any toxins or pollution. Temperature on the South side of Lauropia is always warm with no humidity present. On the North side of Lauropia the weather is always perfect for winter activities, the temperature is just cold enough for the snow to fall. The North side of the island is full of steep, snow-covered mountains that are perfect for skiing. On the South side of the Lauropia clean, sandy beaches cover the land. The ocean water is crystal clear and warm. Lauropia is the perfect place to live. On the island every person would be treated as an equal. No one person would think or act like they were better than someone else. There would be no racism present, all types of people would reside here and get along together. It wouldn't matter if you were African American, Caucasian, Asian, Spanish, Mexican or any other race each and every individual would treat each other the same. Whether a person was heterosexual, homosexual, or bisexual wouldn't matter. Lauropians wouldn't judge each other by their appearance or whom they interacted with. There would be a diverse amount of different religions that would not criticize the other religions for their beliefs. Once a month all the different religions would get together at the island community building and congregate together to discuss their viewpoints and thoughts on each faith. The Lauropians would be involved in a wide variety of sports and leisure activities all year long. This would be made possible because of the extreme temperature differences on the North and South sides of the mountain. The North side would always be cold so the citizen could go skiing and snowboarding at the Lauropian Mountain Resort. The resort would offer a wide variety of different leveled slopes for the skiers on one half of the mountain. On the other half of the mountain there would be a Snowboard Park consisting of a slopes and half pipes strictly for the snowboarders. A snow tubing park would also be available for any whom has interest in snow tubing. There would family tubes and single tubes available for use. For all the snow mobilers on Lauropia, The Lauropian Mobile Park will be open for their riding enjoyment. All these activities and more on North Lauropia will have minimal charges to take advantage of the facilities. On the warm and sunny South Lauropia, the beaches will be clean and free of charge for all citizens. The beaches would have volleyball courts open to anyone. At the piers there would be docks where people could rent Jet Ski's, Speed Boats, Yachts, and Party Boats for their recreational pleasure. Sidewalks and paths would be on hand for Lauropians to roller blade, skateboard, ride bikes, and run, jog, or walk. Boating trips would also be available that take groups out in the middle of the ocean to scuba dive and snorkel. Throughout the whole island shopping centers, eateries, and sports complexes of all types will be accessible. Any store imaginable would exist for the Lauropians to shop for their wants and needs. The women would be in shopping heaven with the amount and variety of stores available to them. The amounts of places to eat would be incredible. They would range from places like Burger King and McDonalds, to Chi Chi's and Lone Star, to five star restaurants. Any type of food that a person had a craving for would be accessible. Sports Complexes would be placed all over the island for Lauropians to participate in any athletic event that they enjoyed. It will be required for all citizens to start their education at elementary school level and continue up to collegiate level. It would not be required, but if the parents wanted to start sending their children to nursery or preschool the facilities would be open for use free of charge. All schooling on the island would be free of charge because education is of great importance to the people of Lauropia. The schools would administer the best education possible. There would be a large variety colleges available for students to choose from depending on their individual or dual major. If a person decided that they did not want to finish their schooling, being banished from the island would punish them. When and if the person decides they want to come back to island to finish their education the school board will have a meeting and decide if that certain person deserves to be let back on the island. On most occasions the student will be allowed to come back. Once a person graduates from college and gets a job, if they decide they want to go back to college to further their education, the company that they work for will usually give them funding for it. Students will be required to go to school for nine months out of the year. Altogether students would be required to attend seventeen years of schooling. In order to insure that the students would be getting an excellent education the teachers would have to take a Teaching Exam every five years. If the teachers fail to complete the requirements and the written section of the test they will not be permitted to teach for one year. After the period of time is up the teacher may retake the test and if he or she passes it, they will then be allowed to teach again. Teachers would also be required to go back to college annually and take two courses to broaden their knowledge. All measures would be taken that would be necessary to maintain the finest quality of education for Lauropians. The citizens of Lauropia would be able to make up their own laws and rules. Each year the members the government would sit down and revise the laws from the years before if necessary. Each community on Lauropia would have representatives that would go around and take ideas and thoughts on how the island could be changed and run to make it better place to live. Laws would never be passed if a large number of people on the island disagreed with them. The main concern that the government would have is the Lauropians happiness.
